1. General
The booking Terms and Conditions apply to the booking of any training or recreational booking provided by Explore 4×4. Please take time to read our terms and conditions before purchasing an activity as many activities may have height, weight and age restrictions. We can advise you of these restrictions when you purchase an activity. Other age restrictions may apply according to the activity. Explore 4×4 do not accept any liability for indirect or consequential losses. Your statutory rights are not affected.
2. Booking Confirmation and Cancellations
No variation to bookings shall be binding unless agreed in writing by Explore 4×4.
No bookings shall be deemed as confirmed unless accepted in writing by Explore 4×4.electronically or by hard copy.
Explore 4×4 will take all reasonable efforts to ensure that you and/or your groups event commences at the time booked.
It is the responsibility that each client ensures that they are ready to participate in their activity at the time given. Late arrivals may not be permitted to take part in the activities, and no refunds or compensation will be made payable by Explore 4×4 in such cases.
Waiting time may be necessary with all activities, especially as some are weather dependent.
Weather, mechanical problems, staff illness or other unforeseen circumstances beyond the control of Explore 4×4 may cause cancellation at short notice.
Should a cancellation occur, Explore 4×4 will not be liable for any costs such as travel or accommodation incurred by the client.
Should the client wish to cancel an activity or event, at least 14 days notice must be given before the date of the activity or event.
Any cancellations less than 14 days will incur a 25% cancellation fee; any cancellations less than 7 days will incur a 50% cancellation fee.
Should Explore 4×4 cancel the activity or event, due to mechanical problems or staff absence, then a full refund will be offered or an alternative activity, if preferred by the client.
If notice of cancellation or postponement is received 1 working day or less prior to the date of the event, all deposits, payments or gift vouchers are forfeited.
Explore 4×4 reserves the right to change or alter the dates, times or the format of scheduled events without prior notice or consultation
3. Insurance and safety
Most of our activities involve some personal risk. All clients receive a detailed safety briefing from an instructor prior to commencement of the activity.
Life insurance policies do vary, if clients are concerned about the activity they wish to participate in, they should consult their insurance company in advance.
Explore 4×4 reserves the right to refuse admittance, or to remove a client from any activity or training course on grounds of safety, e.g. non compliance of safety rules and advice, misuses or damages property belonging to Explore 4×4.
All vehicles are left at owners risk and usual security precautions should be taken.
No client under the influence of alcohol or drugs will be permitted to take part in any activity.
Adult clients must sign a risk acknowledgement and disclaimer stating that they accept responsibility for the safety of themselves.
If the user is 18 years or under, the consent of a parent/guardian will be required.
Where appropriate, all clients are required to wear safety equipment provided by Explore 4×4 and fitted by an instructor.
Clients must be appropriately dressed for any training or activity. Explore 4×4 reserves the right to refuse participation to any client who is not appropriately dressed.
Explore 4×4 will not be responsible for any damage or loss of clothing or other personal items resulting from participation in any activity or training.
Explore 4×4 do not accept liability for the payment of compensation or any losses caused by any act or omission of the client.
Explore 4×4’s aggregate liability to you in contract, tort or otherwise arising in connection with any training or activity undertaken following this booking shall not exceed £1 million.
Nothing contained within these booking Terms and Conditions is intended to, nor shall limit the liability of Explore 4×4 in respect of death or personal injury caused by the negligence of its staff, agents or contractors.
4. Communication and Contact Details
All communications may contain confidential and privileged information that is for the sole use of the intended recipient. Any viewing copying or distribution of, or reliance on a message by unintended recipients is strictly prohibited. If any message is received in error, please notify us immediately by replying to the message and deleting it from your computer.
5. Data Protection
By placing a booking with Explore 4×4, the client consents to their details being retained for accounting and marketing purposes. The details will be kept by Explore 4×4 even after the clients relationship with Explore 4×4 has terminated. Explore 4×4 may use the client’s personal data to let customers know about goods and services similar to the goods or services provided to the client previously, and any others matters that Explore 4×4 consider may be of interest to customers.
From time to time we may send you details of our forthcoming events or information we believe will be of interest to you, either by post, sms or email. Explore 4×4 will never sell your information to anyone else.
We regularly take photographs and videos of our events for use on our promotional materials including online services such our website www.explore-4×4.co.uk and social media services including Facebook. If you have any concerns regarding the use of photography or video from your activity please speak to any member of staff. However, Explore 4×4 will always ask permission to do so
6. Force Majeure
Explore 4×4 shall be under no liability if it shall be unable to perform any obligation which is owed by it to the customer for any reason beyond it’s control, including (without limiting the foregoing) Act of God, legislation, war, fire, flood, drought, failure of power supply, lock-out, strike or other action taken by employees in contemplation or furtherance of a dispute or owing to any inability to procure materials required for the performance of the contract. During the continuance of such a contingency, the client may, by written notice to Explore 4×4 elect to terminate the booking or contract and pay for work done and materials used.
7. Variation to Terms and Conditions
These terms and conditions may be amended from time to time.
8. The Law
These terms and conditions and all other express terms of the booking or contract with clients, shall be governed and construed in accordance with English law. English Courts shall have jurisdiction in relation to any matters arising in connection with any contract between Explore 4×4 and the client into which these terms are incorporated.
